1. Acceptance of Terms

By accessing and using Active AI Writer, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, as well as our Privacy Policy and Cookie Policy.

Eligibility

To use our Service, you must:

• Be at least 13 years of age (or the minimum age required in your jurisdiction)
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the Service under applicable laws
• Comply with all local, state, national, and international laws and regulations

If you are under 18 years of age (or the age of majority in your jurisdiction), you must have your parent or legal guardian's permission to use the Service.

2. Description of Service

Active AI Writer is an AI-powered Chrome browser extension that provides:

• AI Writing Assistance: Generate, rewrite, and enhance text using advanced AI models
• Text Correction: Real-time grammar and spelling correction
• Text Expansion: Keyboard shortcuts for quick text insertion
• Multi-platform Support: Compatible with Gmail, email clients, web forms, and other platforms
• Custom AI Settings: Configure AI models, system prompts, and behavior preferences

Service Availability

We strive to provide uninterrupted access to our Service, but we do not guarantee that the Service will always be available, error-free, or uninterrupted. We may modify, suspend, or discontinue the Service at any time with or without notice.

3. User Accounts

Account Creation

To access certain features of the Service, you must create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Accept all responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use or security breach

Account Security

You are responsible for safeguarding your account credentials. You must not:

• Share your account credentials with others
• Allow others to access your account
• Use another user's account without permission
• Create multiple accounts for abusive purposes

We reserve the right to refuse service, terminate accounts, or remove or edit content at our sole discretion.

4. Subscriptions and Payments

Subscription Plans

Billing and Payment

• All prices are in United States Dollars (USD) unless otherwise stated
• Subscription fees are billed in advance on a monthly or annual basis
• Subscriptions automatically renew unless canceled before the renewal date
• You authorize us to charge your payment method on a recurring basis

Price Changes

We reserve the right to modify subscription prices. We will provide at least 30 days' notice of any price changes. Continued use of the Service after the price change constitutes acceptance of the new price.

Refund Policy

• Monthly subscriptions: No refunds for partial months
• Annual subscriptions: Pro-rated refunds within 30 days of initial purchase
• Refund requests: Must be submitted to support@activeaiwriter.com
• Processing time: Refunds processed within 5-10 business days

Cancellation

You may cancel your subscription at any time through your account settings. Upon cancellation:

• You will retain access until the end of your current billing period
• No refund will be provided for the remaining subscription period (except as stated above)
• Your account will be downgraded to the free plan
• Premium features will no longer be accessible

5. Acceptable Use Policy

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to use the Service:

Prohibited Content

• To generate illegal, fraudulent, or deceptive content
• To create content that infringes intellectual property rights
• To produce threatening, abusive, harassing, or hateful content
• To generate spam, phishing, or malicious content
• To create sexually explicit or obscene material involving minors
• To develop content promoting violence, terrorism, or self-harm
• To generate content that violates privacy or data protection laws

Prohibited Activities

• Attempting to bypass rate limits or usage restrictions
• Reverse engineering, decompiling, or disassembling the Service
• Interfering with or disrupting the Service or servers
• Attempting to gain unauthorized access to any part of the Service
• Using automated tools (bots, scrapers) without permission
• Reselling or redistributing the Service without authorization
• Impersonating others or misrepresenting your affiliation
• Collecting user information without consent

Enforcement

Violation of this Acceptable Use Policy may result in:

• Immediate termination of your account
• Restriction of access to certain features
• Legal action and referral to law enforcement
• Liability for damages caused by violations

6. Intellectual Property Rights

Our Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Active AI Writer and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.

Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

License to Use the Service

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Install and use the Chrome extension on your devices
• Access and use the Service for your personal or internal business purposes
• Use AI-generated content subject to the restrictions below

Third-Party AI Models

We use third-party AI models (OpenAI, Google Gemini, DeepSeek). Your use of these models through our Service is subject to their respective terms of service and usage policies.

7. User Content and AI Processing

Your Content

You retain all rights to the text content you input into the Service ("User Content"). By using the Service, you grant us a limited license to:

• Process your User Content through AI models to provide the Service
• Temporarily store your User Content as necessary to provide the Service
• Use anonymized, aggregated data for service improvement

AI-Generated Content

Content generated by the AI ("AI-Generated Content") is provided to you under the following conditions:

• You may use AI-Generated Content for any lawful purpose
• We make no claims of ownership over AI-Generated Content you create
• You are responsible for reviewing and editing AI-Generated Content before use
• AI-Generated Content may not be unique and could be generated for other users with similar prompts
• You should not rely solely on AI-Generated Content for critical decisions

Data Processing

We process your User Content as follows:

• Direct API use: If you provide custom API keys, your content is sent directly to the AI provider
• Proxied requests: If using our API keys, requests are proxied through our servers but not stored
• No training use: We do not use your User Content to train AI models
• Minimal retention: Content is only retained temporarily for processing and then deleted

8. Disclaimers and Limitations

Service "As Is"

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• Warranties that the Service will be uninterrupted, timely, secure, or error-free
• Warranties regarding the accuracy, reliability, or completeness of AI-Generated Content
• Warranties that defects will be corrected

AI Content Accuracy

We do not guarantee that AI-Generated Content will be:

• Accurate, complete, or factually correct
• Appropriate for your specific use case
• Free from bias, errors, or harmful content
• Compliant with applicable laws or regulations
• Original or non-infringing

YOU ARE SOLELY RESPONSIBLE FOR REVIEWING, VERIFYING, AND EDITING ALL AI-GENERATED CONTENT BEFORE USE.

Third-Party Services

The Service may contain links to third-party websites or services that are not owned or controlled by us. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ACTIVE AI WRITER, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR:

• ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• ANY LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES
• DAMAGES RESULTING FROM YOUR USE OR INABILITY TO USE THE SERVICE
• DAMAGES RESULTING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA
• DAMAGES RESULTING FROM ANY AI-GENERATED CONTENT OR USER CONTENT
• DAMAGES RESULTING FROM THIRD-PARTY CONDUCT OR CONTENT ON THE SERVICE

WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you.

10. Indemnification

You agree to defend, indemnify, and hold harmless Active AI Writer and its licensors, employees, agents, and affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms
• Your use of the Service, including any AI-Generated Content
• Your User Content or any content you submit, post, or transmit through the Service
• Your violation of any law, regulation, or rights of a third party
• Your breach of any representation or warranty in these Terms

11. Termination

Termination by You

You may terminate your account at any time by:

• Uninstalling the Chrome extension
• Canceling your subscription through account settings
• Contacting support to request account deletion

Termination by Us

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:

• Breach of these Terms
• Violation of our Acceptable Use Policy
• Fraudulent or illegal activity
• Request by law enforcement or government agencies
• Extended periods of inactivity
• Discontinuation or material modification of the Service

Effect of Termination

Upon termination:

• Your right to use the Service will immediately cease
• We may delete your account and all associated data
• You will not be entitled to any refunds (except as specified in our refund policy)
• Provisions that by their nature should survive termination will remain in effect

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will:

• Provide at least 30 days' notice prior to any new terms taking effect
• Notify you via email or through a notice on the Service
• Update the "Last updated" date at the top of these Terms

By continuing to access or use our Service after revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you must stop using the Service and may cancel your subscription.

13. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States and the State of [Your State], without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

14. Dispute Resolution

Informal Resolution

We want to address your concerns without resorting to formal legal proceedings. Before filing a claim, you agree to contact us at support@activeaiwriter.com and attempt to resolve the dispute informally. We will attempt to resolve disputes within 60 days.

Arbitration Agreement

If we cannot resolve the dispute informally, you and Active AI Writer agree to resolve any claims relating to these Terms or the Service through final and binding arbitration, except that you may assert claims in small claims court if they qualify.

Arbitration terms:

• Governed by the Federal Arbitration Act
• Administered by the American Arbitration Association (AAA)
• Conducted via telephone, online, or based solely on written submissions
• Each party bears their own costs and attorneys' fees

Class Action Waiver

YOU AND ACTIVE AI WRITER AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
